Please read these Terms of Use ("Terms") carefully before using the Hushed Sleep mobile application ("the App") operated by Hushed Sleep ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 18 years of age (or the age of legal majority in your jurisdiction) and agree to comply with these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Hushed Sleep is a baby sleep tracking application that provides:

• Sleep, nap, and wake window tracking and predictions.
• Feeding and diaper change logging.
• Soothing sounds and a sound mixer.
• Family sync between caregivers via iCloud.
• Sleep analytics, charts, and PDF export for pediatricians.
• Push notification reminders for sleep times.
• Apple Watch companion app.
• Live Activities for the Lock Screen.

3. Medical Disclaimer

Hushed Sleep is not a medical device and does not provide medical advice.

The sleep predictions, schedules, and recommendations provided by the App are generated by algorithms based on general pediatric sleep guidelines and your baby's tracked patterns. They are intended for informational and convenience purposes only.

• Always consult your pediatrician or a qualified healthcare provider for medical decisions regarding your child's sleep, health, or development.
• The App does not monitor your child's breathing, heart rate, or any physiological signals.
• Never rely solely on the App for safe sleep practices. Always follow your pediatrician's guidance and the AAP Safe Sleep guidelines.
• We are not responsible for any health outcomes related to the use of this App.

4. User Accounts & Data

Hushed Sleep does not require you to create an account. Your data is stored locally on your device. If you enable Family Sync, data is shared via your Apple iCloud account, subject to Apple's terms and privacy policy.

You are responsible for:

• The accuracy of the data you enter into the App.
• Maintaining the security of your device and iCloud account.
• Managing who has access to your family sharing group.

5. Subscriptions & Payments

5.1 Free & Premium Features

The App offers both free and premium features. Premium features require an active subscription.

5.2 Subscription Plans

• Monthly: Billed monthly at the current price displayed in the App Store.
• Yearly: Billed annually at the current price displayed in the App Store.

5.3 Free Trial

We may offer a free trial period. If you do not cancel before the trial ends, your subscription will automatically renew and you will be charged.

5.4 Billing

• All payments are processed through Apple's App Store. We do not collect or store any payment information.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your Apple ID account settings.

5.5 Refunds

Refund requests are handled by Apple in accordance with their refund policy. We cannot process refunds directly.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Copy, modify, or distribute the App or its content without our permission.
• Interfere with or disrupt the App's functionality or servers.
• Use the App to collect or store personal information about other users without their consent.

7. Intellectual Property

All content in the App — including but not limited to the design, code, graphics, sounds, text, and the "Hushed Sleep" name and logo — is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Sound Library

The sounds included in the App are licensed for use within the App only. You may not extract, download, redistribute, or use the sound files outside of the App.

9. Family Sync

When you use Family Sync:

• Data is shared between all members of your family group via Apple iCloud.
• You are responsible for who you invite to your family group.
• Any member of the family group can view and modify shared baby data.
• You can leave a family group at any time through the App's settings.
• We are not responsible for data shared with family members you have invited.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability to you for any claim arising from the use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we determine violates these Terms or is harmful to other users or us. You may stop using the App at any time by deleting it from your device.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top. Your continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
